Terms of Service

1. Overview

Capti is a service provided by Lab 37 ("we", "us", "our") that helps you generate professional multilingual captions for Final Cut Pro. By accessing or using Capti, you agree to these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the service.

2. Account & Eligibility

Authentication is handled by Clerk. You are responsible for maintaining the security of your account and for all activity that occurs under it. Capti is not intended for children under 16 years old.

3. Service & Credits

  • New accounts receive 30 free credits per month. One caption generation consumes 10 credits.
  • A paid subscription is available monthly or yearly. Current prices are shown on the subscription page and at checkout, and those are the prices that apply.
  • Credits are a usage unit with no cash value and are non-transferable.
  • We reserve the right to adjust credit limits or service usage based on usage patterns to ensure fair access for all users.

4. Payments

Payments are processed by Polar (Polar Software Inc.), which acts as the Merchant of Record for all transactions. This means Polar accepts and processes payments on our behalf, handles invoicing, and collects and remits applicable taxes (VAT, GST, sales tax) where required. We do not store your full payment card details. By subscribing, you authorize Polar to charge your selected payment method for subscriptions. Payments are subject to Polar's Terms of Use.

5. Data Processing & Providers

To provide the service, your data is stored and processed by the following third-party providers. See our Data Processing & Providers documentation for complete details and links to each provider's terms and privacy policies:

In your browser, PostHog, Vercel Analytics and Google Ads tracking are enabled only after explicit cookie consent. Separately, our backend sends PostHog a small set of pipeline events regardless of that choice; these carry your account identifier but no audio, transcript text, email or name.

  • Convex: Storage of job files (audio, transcription, grouping, SRT, FCPXML) and user data (presets, subscription information, credit amounts) (Privacy | Terms)

6. Acceptable Use

  • Do not upload unlawful, infringing, or harmful content.
  • Do not attempt to reverse engineer or disrupt the service.
  • Respect third-party rights and applicable laws.

7. Generated Outputs

AI-generated transcripts and captions can contain errors. You are responsible for reviewing outputs before use. We provide no warranties regarding accuracy or fitness for a particular purpose.

8. Availability & Changes

We may modify or discontinue features at any time. We aim for high availability but do not guarantee uninterrupted service.

9. Data Retention & Deletion

User data and job files are stored on Convex and are kept until you delete them. We do not automatically delete inactive accounts today; automatic expiry is being built and these Terms will be updated when it takes effect. You can delete individual jobs from the job page at any time, or delete your entire account from the user menu. Account deletion immediately removes your jobs, their files, your presets and your credit balance from Convex. Invoices held by Polar are kept for 10 years, as French accounting law requires. We may also suspend or terminate accounts for violations of these Terms.

10. Limitation of Liability

To the fullest extent permitted by law, Lab 37 will not be liable for any indirect, incidental, special, consequential, or exemplary damages, or loss of data, profits, or business opportunities arising from the use of Capti.

11. Your Content and What You Grant Us

The files you upload, and the transcripts and captions produced from them, remain yours. You grant us only the licence we need to run the service: to store your files, send the audio to our transcription providers and the transcript to our caption-grouping provider, and return the results to you. Nothing you upload is used to train any model, ours or anyone else’s, and we claim no rights in your output.

You are responsible for having the right to upload what you upload. If your files contain other people speaking, you are responsible for having a lawful basis to record and transcribe them.

12. Right of Withdrawal and Refunds

If you are a consumer in the EU you normally have 14 days to withdraw from a purchase without giving a reason (art. L221-18 of the French Code de la consommation).

Capti is a digital service that starts immediately. By subscribing and using the service within those 14 days you expressly ask us to begin performance straight away and acknowledge that you lose your right of withdrawal once the service has been fully performed (art. L221-28, 1° and 13°). If you have not used any credits, email contact@usecapti.com within 14 days and we will refund you in full.

Outside that window, subscriptions can be cancelled at any time and take effect at the end of the paid period. We do not pro-rate partial periods. Refunds are handled by Polar as merchant of record.

13. Governing Law and Disputes

These Terms are governed by French law. If you are a consumer, this does not deprive you of the protection of the mandatory rules of the country where you live, and you may bring proceedings in the courts of that country.

Please contact us first at contact@usecapti.com — most things are resolved that way. If we cannot resolve it, you may refer the dispute free of charge to a consumer mediator: [mediator name, address and website to be added]. You may also use the European Commission’s online dispute resolution platform at ec.europa.eu/consumers/odr.

14. Changes to These Terms

We may update these Terms from time to time. Where a change materially affects your rights we will tell you before it takes effect, and continued use of the service afterwards constitutes acceptance of the updated Terms.
